Are health premium contributions required for school-year employees in July and August?
June 29, 2006Q: Are cities, towns and school districts required to contribute for the months of July and August toward the health insurance premium cost for school-year employees such as cafeteria employees and teacher aides?
A: Since 1992, Section 2(d) of Chapter 32B has required governmental units to provide contributions toward the health insurance premium cost of teachers during the months of July and August. The Legislature recently amended Section 2(d) to require that governmental units provide all “other public school employees” with that same benefit.
As amended by Chapter 90 of the Acts of 2006, the applicable sentence of Section 2(d) is now as follows:
“Teachers and all other public school employees shall be deemed to be employees during the months of July and August for purposes of this chapter; provided, however, that employee contributions for such health insurance for those two months are deducted from the compensation paid for services rendered during the previous school year.”
Chapter 90 added the words “and all other public school employees” to this sentence. Chapter 90 was deemed an emergency law that was effective upon its passage on May 19, 2006.
